I have reviewed the bill. In my opinion, it prohibits under any circumstances
the slaughter of a horse in Illinois for human consumption. The prohibition
extends to slaughter in federally inspected facilities. The bill does
not, however, prohibit all slaughter of horses in Illinois. It permits
slaughter of a horse in Illinois, whether in a state or federally
inspected facility, if the intended use of all of the meat is for
purposes other than human consumption, i.e., pet or zoo animal food.
A possible loophole in Sec. 1.5(b) could be closed by replacing
of slaughtering with that the person or another will slaughter.
The modified sentence, with the proposed change in italics, would
then read:
(b) Notwithstanding any other provision of law, it is unlawful
for any person to possess, to import into or export from this State,
or to sell, buy, give away, hold, or accept any horse with the intent
that the person or another will slaughter the horse if the person
knows or should know that any of the horse meat will be used for
human consumption.
